MAKING AN OFFER


When making an offer, keep in mind that it could easily become a legally binding contract if the seller accepts it. Because of this, you need to make sure the offer includes all the terms and conditions you want it to cover. This is where I come in. I will assist you in drafting your offer as well as present it to the seller or the seller's representative on your behalf.

The offer will include the following:
  • Address and legal description of the property
  • Sale Price
  • Deposit 
    • amount of earnest money accompanying the offer, becomes part of your down payment
  • Seller's promise to provide clear title (ownership)
  • Conditions
    • specifies events that must occur in order for the purchase to occur (i.e. the offer is conditional upon the buyer obtaining financing from a lending institution)
  • Inclusions and Exclusions
    • fixtures and/or chattels that are included or excluded from the offer (i.e. appliances, electrical fixtures, etc.)
  • Closing or Possession Date
Negotiating Tips

You will be in a stronger bargaining position if:
  • You are an all-cash buyer;
  • You are pre-approved for a mortgage;
  • You currently do not have a home that needs to be sold before you can buy.

Under the above circumstances, you may be able to successfully negotiate the listed price.  However, in a seller's market, if the home of your dreams comes on the market, you may want to offer the list price (or more, especially if there are other offers on the seller's table). 

The Seller's Response To Your Offer

Upon receiving your offer, the seller may do one of two things:
  • accept the offer as it stands
  • counter the offer with changes the seller prefers

The document becomes a binding contract only when one party finally signs and acceptance of the other side's proposal.
